Coopers Group AG is the organizer of this photo contest called "Coopers Photo Contest 2023". By entering the Coopers Photo Contest 2023, you agree to the terms and conditions set forth herein. You agree that a photo in which you are depicted may be published and used in its entirety. Furthermore, you transfer the copyrights, as far as legally permissible, or the exploitation rights, of the photos uploaded by you to Coopers Group AG to the extent necessary for the implementation of the photo competition. Insofar as you are not the author of the uploaded photo, you must obtain the consent for use as well as for the transfer of the necessary copyrights or exploitation rights to Coopers Group AG of the actual author. Participation in the photo competition is free of charge (apart from the usual communication costs). The competition will take place from 15.07.2023 – 10.09.2023 and includes the selection of 1 winning photo or video, which will be rewarded with a voucher for an overnight stay in a spa double room at the Stoos Lodge worth CHF 433.00. The winner will be determined by a publicly accessible election (via PollUnit) from 07/15/2023 – 09/10/2023. The prize will be awarded to the winner who meets the following participation criteria.
A successful contest participant:
- Must be a natural person of at least 18 years
- should own an original Coopers beach ball
- should have submitted at least one photo or video that received the highest number of votes in the public poll via PollUnit
Entries via third parties, agencies or by automated means (e.g. scripts and macros) will not be accepted and will prevent an entrantin from being admitted to future contests. Entries that do not comply with the terms and conditions of participation will not be admitted to the public selection of the winning photos.
Determination and notification of the winner
Coopers will contact the winner within the first 5 working days after the end of the competition in order to organize the delivery of the prize. From the moment of the notification of the prize, a period of 72 hours begins in which the winner can inform Coopers Group AG of the postal address for the mailing of the prize. If a winner does not notify Coopers Group AG within this period, Coopers Group AG may award the prize to another participant selected in accordance with these terms and conditions.
Coopers reserves the right to name the winner publicly, via social media channels and on the company homepage (without mentioning the full first and last name). PollUnit itself has nothing to do with the competition and is not available as a contact person.
Other provisions
Coopers accepts no liability for any transmission errors, loss of data, in particular in the course of data transmission, or other disruptions to performance as a result of technical defects.
Coopers reserves the right to exclude participants from the competition on the basis of false information, manipulation or the use of unauthorized aids.
All decisions made by Coopers are final and will not be justified. Legal recourse is excluded.
These conditions of participation and the competitions are governed exclusively by Swiss law. The courts at the registered office of Coopers Group AG shall have exclusive jurisdiction over any disputes relating to these Terms and Conditions of Participation.
Should individual provisions of these Conditions of Participation be or become invalid, the validity of the remaining provisions of these Conditions of Participation shall not be affected.
Coopers reserves the right to change or even discontinue the photo competition or its procedure (including these conditions of participation) at any time without notifying participants separately and/or to replace the prize if this should be necessary due to unforeseeable, external circumstances. Coopers declines any liability for such cases.
There will be no cash payment or exchange of the prize.
Internal employees of Coopers Group AG or other Coopers companies are excluded from participation in the prize draw.
Limitation of liability
Coopers has organized the photo contest in good faith and cannot be held liable for any damages of any kind or origin whatsoever in connection with participation in this contest, including the awarding of prizes and the subsequent consumption, redemption or use of the prizes themselves.
